Major Obstacles

The right to acquire the freehold of a building of residential flats, a transaction known as collective enfranchisement under the Leasehold Reform Housing & Urban Development Act 1993, offers leaseholders the opportunity to dramatically change the status of their flats from leasehold with a finite term, to share of ownership of the freehold in perpetuity. The enhancement of the value of the leaseholders’ properties can be significant, and the removal of a difficult or negligent freeholder – and headlessor where relevant – will result in greater control of the building by the leaseholders, presenting an opportunity to further enhance the value through improvements to the building, tighter management of the service charge, and cancellation of the ground rent. The right to collectively enfranchise is relevant only to qualifying leaseholders and to qualifying buildings. Bluepoint Consulting will help you understand the qualifications, the obstacles, and the steps in this complex Leasehold Reform process, and will ensure that your time and money are not wasted pursuing the wrong route.
